Smithfield Class Action Lawsuit ($75 Million!!!)

In this Smithfield Class Action Lawsuit, Smithfield Foods, Inc. has agreed to pay a $75 million settlement to consumers who purchased pork products manufactured by JBS USA Food, Clemens Family, Hormel, Seaboard, Smithfield, Triumph, Tyson and Agri Stats between Jan. 1, 2009, and April 2, 2021.

Settlement Details: Smithfield is accused of raising and fixing the prices of pork products by colluding with other pork producers. Smithfield has not admitted to any wrongdoing but has agreed to settle these claims by paying $75 million to qualifying purchasers. Additionally, JBS agreed to settle similar anti trust allegations by paying $20 million.

This lawsuit dates back to 2018 in which several pork producers, such as Hormel and Tyson were involved in similar price fixation collusion.

Who is Eligible to File a Claim?

To qualify for potential claim benefits, class members must have purchased pork products (from a retailer or club store) that were manufactured by JBS USA Food, Clemens Family, Hormel, Seaboard, Smithfield, Triumph, Tyson and Agri Stats between Jan. 1, 2009, and April 2, 2021. 

They aren’t too specific about eligibility requirements. Therefore, if you purchased any pork products from a major brand between 2009 and 2021 then you should file a claim. On the claim form, they will ask you a few basic questions about yourself. Additionally, they ask that you give an approximate number of pork products you purchased per month between Jan. 2, 2009 and April 2, 2021. Finally, they will ask you to give an approximate amount of money you spent monthly on pork products from these major pork manufacturers.

Important Deadlines, Dates and Your Rights

  • Deadline for Exclusion: Feb. 7, 2023 (the only option that allows you to be a part of any other lawsuit against Smithfield concerning the released claims)
  • Deadline for Objection: Feb. 7, 2023 (you have the right to write to the court about why you don’t agree with the settlement)
  • Final Approval Hearing: March 30, 2023 (you have the right to ask to speak in court about the fairness of the settlement)
  • Claim Forms Must be Submitted by: June 30, 2023 (required to receive potential benefits)
